Facts:

Defendant appealed a judgment of a trial court (Maryland), which convicted him of a third degree sexual offense, in violation of Md. Ann. Code art. 27, § 464B (1957, 1996 Repl., 2001 Supp.).  Defendant, who was 21 years old, gave a voluntary statement to police in which he admitted that a 15-year old girl performed fellatio on him. Defendant was convicted of a third degree sexual offense. On his appeal, the court affirmed.

The Maryland Court made the following holding:
  • Md. Ann. Code art. 27, § 464B(a)(4) (1957, 1996 Repl., 2001 Supp.), provides that a person is guilty of a sexual offense in the third degree if the person engages in a sexual act with another person who is 14 or 15 years of age and the person performing the sexual act is at least 21 years of age. A sexual act, as defined in Md. Ann. Code art. 27, § 461(e), includes fellatio.
